1. Seller identification
These Terms of Sale (hereinafter "TOS") are entered into between:

2. Purpose
These Terms of Sale govern the subscription, payment, and commercial use of AwesomeFor.ms, an online service (SaaS) for creating and managing online forms.

3. Definitions
- Service : the AwesomeFor.ms platform and all its features.
- User : any natural or legal person with an account on the Service.
- Consumer : any individual User acting for purposes outside their commercial, industrial, artisan, liberal, or agricultural activity (preliminary article of the Consumer Code).
- Professional : any individual or legal entity User acting within the scope of their professional activity.
- Subscription : the subscription contract to one of the pricing plans offered by the Service.
- Billing period : the period between two payment due dates (monthly or yearly).
- Form : any form created by the User through the Service.
- Response : any submission made by a third party through a Form.
4. Plans and pricing
The Service is offered in four pricing plans:
- Free : 0 EUR/month — 3 forms, 50 responses/month. No AI generation, no notification emails, no storage.
- Starter : 9 EUR/month or 84 EUR/year — 10 forms, 500 responses/month, 10 AI generations/month, 500 notification emails/month, 500 MB storage.
- Pro : 19 EUR/month or 180 EUR/year — 25 forms, 2 000 responses/month, 50 AI generations/month, 2 000 notification emails/month, advanced customization, webhooks, embed, 2 GB storage.
- Business : 49 EUR/month or 468 EUR/year — unlimited forms, 10 000 responses/month, 100 AI generations/month, 10 000 notification emails/month, priority support, 10 GB storage.
VAT not applicable, article 293 B of the French General Tax Code. Detailed limits and features for each plan are available on the Service pricing page.
5. Subscription and acceptance
Subscription is done online through the Service. In accordance with Articles 1127-1 to 1127-3 of the Civil Code, the subscription process includes the following steps:
- Choice of pricing plan and billing period
- Order summary review
- Express acceptance of these Terms of Sale (checkbox)
- Order validation and payment
A confirmation email summarizing the Subscription details is sent to the User after payment validation.
6. Right of withdrawal
In accordance with Article L221-18 of the Consumer Code, the Consumer has in principle a period of 14 days to exercise their right of withdrawal from the conclusion of the contract, without having to justify reasons or pay penalties.
However, in accordance with Article L221-28 13° of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium where performance has begun with the Consumer's prior express consent and express waiver of their right of withdrawal.
During subscription, the Consumer User is asked to check a box by which they:
- expressly consents to the immediate execution of the Service;
- acknowledges waiving their right of withdrawal from the start of the Service execution.
7. Payment
Payment is made by credit card through our payment provider Stancer. Charges are automatic at each Billing Period (monthly or yearly). Card data is securely processed by Stancer and is never stored on our servers.
In case of payment failure:
- The User is immediately notified by email.
- A new payment attempt is made 3 days after the initial failure, then 7 days after.
- If payment remains unsuccessful after 14 days, the Subscription is suspended and access to the Service is restricted.
The User may update their payment details at any time from their account dashboard to regularize their situation.
8. Duration, renewal and cancellation
The Subscription is for an indefinite period with monthly or yearly billing. It is automatically renewed at each Billing Period.
In accordance with Articles L215-1 to L215-3 of the Consumer Code, the Consumer User is notified by email at least one month before the renewal date of the option not to renew their Subscription.
The User may cancel their Subscription at any time from their account dashboard. Cancellation takes effect at the end of the current Billing Period. The User retains access to the Service until that date.
For monthly subscriptions, no refund is provided. For yearly subscriptions, if cancellation occurs within 30 days of subscription or renewal, a pro-rata refund of remaining full months is provided.
9. Plan change
The User may change their plan at any time from their account dashboard.
- Upgrade to a higher plan : the new plan takes effect immediately.
- Downgrade to a lower plan : the change takes effect at the end of the current Billing Period.
When downgrading, if the User's usage exceeds the new plan's limits, existing data is preserved but excess features are blocked until usage complies with the new limits.
10. Usage limits and quotas
Each plan has usage limits (number of forms, responses, AI generations, notification emails, file storage). Detailed limits are available on the pricing page.
- The User is notified by email when they reach 80% of a quota.
- When a quota reaches 100%, the related feature is temporarily blocked until the Billing Period renews or the User upgrades.
- When the response quota is reached, public forms display a page indicating that the form is temporarily unavailable.
11. Personal data

Le Service est hébergé au sein de l'Union européenne (Hetzner Online GmbH, Allemagne). La liste complète des sous-traitants techniques est disponible dans notre Politique de confidentialité.
Under the General Data Protection Regulation (GDPR):
- AwesomeFor.ms acts as data controller for its Users' account data.
- AwesomeFor.ms acts as data processor (Article 28 GDPR) for data collected by Users through their Forms. The User remains the data controller for such data and must ensure compliance with applicable regulations.
The User has the right to access, rectify, delete, and port their personal data, which they may exercise by contacting us by email.
12. Data retention after cancellation
After subscription cancellation, the User's data (forms, responses, files) remains accessible in read-only mode for 30 days.
During this period, the User may export their data (forms and responses). At the end of this 30-day period, all data is permanently deleted.
13. Force majeure
In accordance with Article 1218 of the Civil Code, neither party shall be held liable for failure to perform its obligations if such failure results from an event beyond its control, which could not reasonably have been foreseen at the time of the contract and whose effects cannot be avoided by appropriate measures.
The affected party's obligations are suspended for the duration of the force majeure event. If the event continues beyond 90 days, either party may terminate the contract without compensation.
14. Limitation of liability
AwesomeFor.ms's liability under these Terms of Sale is limited to the total amount actually paid by the User during the twelve (12) months preceding the event giving rise to the damage.
For Professional Users, AwesomeFor.ms shall not be liable for indirect damages, including data loss, loss of profits, loss of revenue, or reputational harm.
For Consumer Users, the above exclusions do not apply in case of gross negligence, breach of an essential contractual obligation, or personal injury.
15. Modification of Terms of Sale
AwesomeFor.ms reserves the right to modify these Terms of Sale. The User is notified by email at least 30 days before the changes take effect.
For substantial modifications (including prices or usage limits), the User's express consent is required. The User who refuses the new terms may cancel their Subscription at no cost before they take effect.
Continued use of the Service after the 30-day period constitutes acceptance of non-substantial modifications.
16. Applicable law and disputes
These Terms of Sale are governed by French law.
In case of dispute, the parties agree to seek an amicable solution first.
Consumer mediation
In accordance with the provisions of the Consumer Code concerning the consumer dispute mediation process, after contacting AwesomeFor.ms and in the absence of a satisfactory response, the Consumer User may use a free consumer mediation procedure with:

Jurisdiction
For Consumer Users, legal rules of territorial jurisdiction apply in accordance with Article R631-3 of the Consumer Code. For Professional Users, the competent courts are those of AwesomeFor.ms's registered office.
